Criminal Law - What is an arraignment?
What happens at the arraignment? Arraignments are one of the first steps in the process in the criminal case in Michigan. During the arraignment, The judge will inform the defendant of the criminal charges and his or her constitutional rights. In response to arraignment, the accused is expected to enter a plea. The pleas that might be entered (guilty, not guilty, or stand mute). Our recommendation is to ask the Judge to enter a plea of "Not Guilty" . Do not plea guilty until you speak with a lawyer. If the defendant pleads not guilty, a date is set for a preliminary exam hearing, pre-trial or a trial. At the arraignment, the presiding judge also decides at what amount, if any, to set bail. The Judge will look to many factors in deciding the bond such as the nature of the crime, the criminal history of the defendant, wether the defendant has a job, asset and other factors. The judge has discretion to give a personal bond, reasonable bond, high bond or no bond. If you are unable to hire a lawyer, at the time of the arraignment, the judges will appoint a lawyer for you.
